Hillary: the FBI Versus the DOJ
There is an institutional battle going on in Washington on the very eve of the elections. The FBI, under Director Comey, is pushing back against the Department of Justice, under Attorney General Lynch. And using the media - especially Fox News - to also push back against a public lynching in the media of Director Comey. All because of his letter to Congress Committee heads, which basically re-opened the email investigation.
In fact, as Fox News and Jim Geraghty are pointing out, the FBI is now leaking that there have been multiple investigations of Hillary Clinton and the Clinton Foundation underway for some time now at the FBI.
Attorney General Lynch has herself to blame for this dramatic power struggle and for it being litigated through the media. Or perhaps we have a reporter, Christopher Sign, to thank for this messy but increasingly transparent fight going public. When Lynch met privately with Bill Clinton on the tarmac in Phoenix earlier this year, the FBI itself ordered that reporters to put away their phones, and that there be no photos, or no pictures taken. National Security with capital letters required FBI agents to curtail the first amendment rights of the press at Phoenix? When Lynch and Bill Clinton supposedly talked about grandkids and golf??
But of course the story leaked, and the troubling undercurrents of corruption were once again shifted clearly into the view of voters. Director Comey did not want this to happen. One suspects he would have been happy proceeding with FBI investigations of the Clintons and their foundations, away from the glare of the media. But his hand was forced by Lynch's blatant disregard for ethics, an unforgivable display of partisan coziness by the nation's chief lawyer. So the drama was set in motion, like a Greek tragedy. Inexorably moving towards conflict and downfall.
Or the final act of a long-running drama was set in motion. The Clinton's and their history need not be repeated here. The list of scandals is well-known and it now includes a few more recent entries. And what the FBI seems to be suggesting is that there was plenty of reasons - Judge Napolitano's hissy fits aside - for them to finally do what they should have done last summer. Or, in fact, to publicly announce that they will continue what they have already been doing for some time. So that Weiner's laptop is just the latest piece of evidence in a series of investigations that reach beyond Hillary's private server. And involves multiple witnesses who are being interviewed multiple times.
The FBI, in other words, has let the DOJ and the rest of America know that these investigations are not going anywhere, and angry self-interested editorials in the WSJ by those on Wall Street terrified of a Trump presidency are not going to make Comey resign, or turn from his obligations as the Director of the FBI.
