Memos Through the Back Door
What does it mean to not possess legal status but still be not unlawfully present in the USA? It seems one has to wait for the latest lawsuit by the ACLU against the US Citizenship and Immigration Services to see what definition issued by which department will confer what kind of status on someone who arrived in the country without following the law. And to see how any paticular State reacts with legislation or orders of its own.
In this twilight zone, who is subject to deportation and who may not be is an increasingly baffling battle of rules and deadlines that makes one pity the officers who have to enforce -- or more likely not enforce -- this maze of regulations. Deferred Action for Childhood Arrivals, or DACA, suspends deportation orders for a couple of years conditional on ... let's just say thereÂ´s plenty of forms to fill out and if you get the paperwork right and qualify then you get a stay of proceedings.
So what is DACA, legally or legislatively speaking? Is it legislation passed by Congress? Actually no, it's a memorandum courtesy of the Administration and implemented by Janet Napolitano at Homeland Security. Is this how the immigration issue will be worked out? By back door memos and agency infighting rather than clear legislation? Bureaucraatic fiat and judicial activism rather than Congress -- that would be both Houses -- legislating?
As California forges ahead with its DREAM Act providing tuition assistance to those whose parents came in illegally, concerns about costs have been raised. Given California's finances, money earmarked for DREAM is money that might have gone elsewhere. Is it an investment for those lucky enough to get it? It sure is, but beyond the concerns over costs -- Free tuition for anyone anywhere who wants to come to the country? Medical Insurance? Arts Grants anyone? -- is the issue of legislatures and law; those framing principles that made and continue to make America a nation that people around the world want in on.

It is a discomforting feeling, AllardK, being subject to a ‘do nothing congress’ and ruled by whomever happens to be in WH at the time.

With the founding of political parties the moneyed influence has worked to get their tentacles around the power seats of gov’t. Really ramped up with the Regan admin and the fall of the Soviet Union. After the cold war natl security began to take a back seat to commerce. The ‘peace initiative’ gained thru nuke proliferation programs allowed plenty of room for corporations to spread their wings.
Unfortunately, the Constitution has little to say about commerce and the corpocracy has been able to run just about every facet of gov’t using commerce as a venue. Today, Corpocracy shies from making strong legislative stands to protect their power bases from irritant voters. Rather than legislate on sensitive and major issues it is preferred to let the Exec Branch take charge of leading the country. Whether it is the Patriot Act, immigration, healthcare, etc, the Exec Branch does most of the heavy lifting and taking the heat for incumbent legislators, especially so in a presidents second term.
In brief, we each should ask ourselves whether things are going better now than a decade or two hence and act accordingly at the ballot box. Ironically, incumbents continue to be returned to office some 85-90% of the time.
The new Fed chair says it will take ‘a coupla more years’ to get the economy back on track. Largest tax revenue ever collected this year, some $1.5T. After paying for entitlements and the debt some $300B is left to run the gov’t/defense. Meanwhile, the debt clock has ticked on up there to around $18T, soon to reach $25T.
The Corpocracy has put the clamps on our Constitutional right to an article V Convention. And, we have proven time and again that we can’t/won’t vote incumbents from office. That only leaves one other way, short of a real revolution, to save the Republic.
We need a new 3rd party w/a/dif/pol/att.
Otherwise, we have the Corpocracy we deserve.
