If there is impossible to link a a series of communications with a repeating phone number or ID, then all the analysis produces is nothing.

Consider: assume a terrorist places 20 phone calls to different phone numbers or computer IDs. Ten from different public phones and ten through Internet sites using different IDs. It looks simply like 20 communications. Remember the first law of data processing: Garbage in, Garbage out. No useful information is obtained. If terrorists are smart enough to be planning an attack, they are smart enough to hide their communications.

David, I don’t think you should apologize for that kind of wry and heavy sarcasm! Personally, I think that when one is confronted with the kind of irrational and non-sensical justifications and bullsh*t rationales which have become Bushco’s stock-in-trade, it is not only a natural and obvious response for people to give, but is in fact, often a vitally necessary attitude to take in order to hit the Truth Target at it’s very center.

“If we had a Sept. 11 every year, then citizens, regardless of the country, would doubtless be ready to abdicate a good portion of their rights in this area,” said French lawmaker Alain Marsaud, a former anti-terror investigator.”

“”If they are doing what I think they are doing, then I guess my answer is: ‘Why on earth wasn’t this done a long time ago?’” Bell said. “If it is something more sinister then, no, I wouldn’t like it.”

Nice, courageous post. I agree. The purpose of data mining is to find patterns of use. Marketeers want this information in order to determine the best ways to market their wares. Politicians want this information to determine the best ways to sway the public. In all these cases, sooner or later, they must make reference to specific types of actors - consumers - if not to the actors themselves.

As far as terrorists go, most of them are outside the country and we have no idea how they interact with others. We’d be better off learning more about their behavior - where they live. We need live spies, not mining.

Haven’t we already found out that they use internet cafes and other sources to access myspace, yahoo mail, and other accounts. They figured out that if they don’t email each other, and instead just share one account and save the messages as a draft, it never leaves the server, so there is no way to track their activity.

Even if the government had the constitutional right to look at those servers (they don’t), they couldn’t possibly filter through the millions of users, and succesfully determine which is a terrorist conversation and which isn’t, because they use code speech for their transmissions.

It’s blood effective, and frankly, there isn’t really a way to disrupt their communcations.

All of this was old news when it came out earlier in the year, so what is all this phone tapping really doing?

Perhaps,but that’s what several friends at M.I.T tell me.
I am told that there exists software pretty much beyond the most parnoid’s imagination….and it’s yielding dividends.
This software was of the same family used to track sophisticated banking transactions.
My view:If you believe in the school of thought that this administration(or any administration)is criminal/Nazi/nefarious/Big Brotherish…well,that’s it..nothing I can say will change your mind whatsoever.However,if you are from the school of thought that honest career professionals are using these sorts of tools to catch bad guys,well,that’s another conclusion I guess.

Conyers explains that the “Report suggests that in providing the NSA with millions of phone records of innocent Americans, the telephone service providers violated a number of Federal statutes including the Communications Act of 1934 and 18 U.S.C. § 2701 governing access to stored electronic communications and transactional records. In addition, the NSA may well be in violation of both FISA and related federal laws governing trap and trace devices.”

In fact, if I remember right, one of the main assertions that Atta was NOT the man who met with the Iraq liaison was because his personal cell phone was used in the US during that time. Are you suggesting that that argument should be thrown out since we know that terrorists are smarter than that and wouldn’t be using their personal cell phones?

I don’t believe very many Congressmen started their career by saying “When I get to DC I’m going to pander to K-Street” (DeLay et.al. excepted). But to get there they compromised their ideals and became used to those compromises. While they’re there they compromise their agendas to get “something” done. To stay there they compromise their character to obtain contributions.
There is no difference when we compare this to the NSA operative who used to be told “You are the protector of Freedom” and is now told “To protect our Freedom you must violate our Freedom” Eventually, they become accustomed to what used to be uncomfortable and the violations becomes commonplace. The bosses become comfortable with the power and take more. BushCo has opened the Pandora’s box of despotism and is convincing otherwise decent people that they are not the bad guys and says “trust me, I am not a criminal”. You’re old enough to remember CREEP and J Edgar, how is this different?

What exactly are you saying, that the government could feasibly follow every message sent by myspace, gmail, yahoo, and every other online community, every message saved and every other form of internet communication? They would have to track all of them, and somehow determine who is a terrorist and who isnt, and then identify what is a terrorist communication and what isnt, and then decode the messages.

This would require a lot of resources, and it would likely not yeild much, because there would be so much noise to filter. You’d be more likely to dismiss terrorist messages than you would be to intercept them.

Besides that, the data is all encrypted, we aren’t talking about open servers for searching, we are talking about networking sites who keep user databases locked down as tight as technology will allow. The government would spend more time picking through messages between cheating spouses and teens buying X off each other than they would finding anything of intelligence value.

So no, there is no way to combat that form of communication, not under current law, and not realistically in the foreseeable future.

Frankly, I don’t want my government to be that invovled in that scale of intelligence work, because the costs would be enormous, and the potential for abuse is immense.

In all the spy thrillers I read, the spies know they are being watched and that telephones are tapped. They use surreptitious signals, leave messages in the park under a stone, use classified ads, and only deal in cash transactions. Do you think maybe Osama reads spy novels?

I suspect what they look for is the beginnings of political activity that gets them close to networks of underground activity.

They read the writings on the wall so to speak and then infiltrate. There is really nothing new here, except it’s a little easier to do from their office now. This is a return to the old techniques of the FBI. That to me seems the likely scenario of any usefulness of this data mining.

The problem I have with all this is what ends up happening is that this becomes a political suppression tool. Nixon wanted John Lennon deported for his politically powerful resistance to the Vietnam war. He wasn’t a terrorist. All we can do is tamp it down when we discover it. It won’t stop. Power seeks control.

Just a note here. The Church Committee operated circa 1975. FISA was enacted in 1978. Iran Contra began in 1980. The FBI, CIA and IRS investigated and harrassed churches in Dallas that advocated Peace in Central America.

What wil happen here is a few political manuevers, new legislation, and business as ususal.

(a) The first thing you do is profile, you look for patterns of behavior. The second thing you do is read all the communications. Then you decide if you need actions. So it is my contention that the gov’t is capable of doing that for all communications and all computers in all languages. And, yes, those servers and databases are available for intrusion via invasion or subpoena.

No, phone records aren’t important! That’s why businesses all over the world pay a lot of money to purchase them. In the word’s of the great Mark Steyn, “You cannot connect the dots, unless you first have the dots to connect”.

We found the records of the 9-11 hijackers after the fact, and they were quite revealing. Anyone with knowledge of Al Queda and Islamic terrorism (pardon the repetition), could have seen it. Only they never did.

To date, we really don’t know how effective it’s been to spy on us, torture people, etc. But, I can’t help believing that if it had even been helpful in one case the administration would have leaked it. I can only conclude that it hasn’t led to anything, except, of course, to our losing the high ground on the issue of humane ideals, which would have been unthinkable after 9/11. This is still the only reason that Bush gives for the invasion, that it would set up a democratic ideal for other Arab nations to emulate - failure!

Sic Eagle, The Church Commission, OUR representatives in a bi-partisan fashion, chose to do what they did because of horrendous abuse of power by the CIA and the White House. Which is worse? An occasional attack by terrorists or a permanent undermining of Constitutional Rights and liberties by our own government? The former plays well to fear, the latter plays well to reason. Our founding fathers feared the latter far more than the former as is obvious by the founding documents upon which our nation was built.

Our enemies come and go. But, an enemy of the Constitution in government is far more difficult to get rid of or defeat when secrecy is their cloak, and fear of “them” their battle cry. Its a magicians trick of misdirection.

Since he is not a world leader he would have been a legitimate target without a new EO. Besides, Plame was doing a good job and I’m sure there are hundreds more on the ground. If Saddam, OBL, and the presidents of Iran and North Korea all happened to die in completely unrelated accidents sometime soon, the world probably would be a better place.

But assassination? If we put that kind of judge/jury/executioner power into the hands of the executive of the most powerful country on Earth, the benefits would fail to outweigh the costs.

The goal is to stand up against the Bad Guy, while still remaining a Good Guy. It does no good to defeat the Bad Guy if you become as bad as he is in the process.

Anyway: Open minds know that all sources are to some extent biased (univision) and multiple viewpoints are needed for a more accurate postioning (binocular:-). I will stand by the comment that the Church Committee posting was particularly slanted in that it took positions beyond fact and included statements that were clearly opinion. Maybe it’s just Wiki enforcing the “no weasle word” preference.

I’m still waiting for an answer to my CREEP/Hoover question.

Thats like saying discussing the weaknesses in the body armor of our soldiers is telling the enemy our problems. What it does is make people aware that there is a major problem that needs to be fixed, the wrong people are already more than aware of the things the general public doesn’t know.

All of this started a long time ago. Remeber the office the DARPA started right after 9-11 focused on developing, and this was the title of the organization, Total Information Awareness.

They wanted to unify several different DOD projects in order to create a database which would essentially keep track of everyone in the country.

They got de-funded because what they were doing was, frankly, completely insane in nature. As far as I know, no one wants the government to keep massive databases tracking everything public (and as much private as possible) people do, including transactions, internet behavior, telephone calls, etc.

Combine that with the growing usage of closed circuit television surveilance, like that in NYC, Washington, Baltimore, and other cities, and things get really scary. It starts as a tool to fight terrorism, but then the government lets the tools be used for other law enforcement, say, shutting down drug trafficking. Then unreasonable laws, such as outlawing sex toys or other limitations on personal choice that have nothing to do with public safety, start getting enforced through this very efficient system.

That in and of itself seems unreasonable to me, and that isn’t really any sort of abuse, its simply expanding the scope of a program and harshly enforcing what is a legitimate law.

Consider the amount of power that could be used against opponents in elections or groups of dissenters.

They couldn’t possibly combat this particular internet approach because these accounts aren’t being used to email each other, they are saving drafts on their own account. This means there is no behavoir to track, and more importantly, no data trail to track if they wanted to, its a local opperation between computer A and server B, with nobody in between. Its genious, and unless the government actually took control of the servers and had access to each account (I don’t think admins on myspace can access individual’s personal messages, but I could be wrong), there would be no way of looking at the materials they would need to mine data. They cannot supoena the data because nothing these accounts are doing would be probable cause. That means theyd have to either hack it, which is uncostitutional and time consuming, or just let the communications go by, which is probably what they are doing now.

You say that you see no use of monitoring phone number dialing patterns. Your bio suggests you have a backround in IT, so as an IT person myself I find it a little hard to understand why you would dismiss this out of hand.

If you found that a number in Pakistan was being dialed from phone booths in a geographic region, would you suggest we ignore this info? If the number in Pakistan then turns out to belong to an individual with terror ties would that not be useful in twarting terror in the US. Do you not think a little under cover work is in order?

The vast majority of phone numers in the US are public. You dont need a warrant, just a phone book. If compiling a data base containign phone numbers, names, and addresses is a violation of civil rights, there are a lot of telemarketers out there that should be real nervous.

To say terrorists wont use their personal phones therefore dialing patterns are irrelevant is just too narrow minded. If the calls were coming from your neighbors house I bet you would feel differently.

there is a program the FBI uses and I sure other agencies as well that is able to track most of the communication on the internet. It looks for key words and if it finds them then it looks further into it and if the program determines there is a statistical probability of finding something of use then it is brought to the attention of who ever needs to be.

yes they are able to track things way beyond our understanding. it is a bit scary but they have had this power for a long time. It was scaled back due to privacy but if need be they are able to release the full power of it and then truely nothing we say would be private.

I know this sounds conspiratorial but it is not.

Intelligence committees in both Houses have been briefed as have party leadership including Pelosi and Reid. That is the necessary check. The U.S. Supreme court in 1979 ruled specifically that phone records are not protected by search and seizure laws. That is the balance.

While I admit that analyzing calling patterns will not end terrorism, that does not mean that data from these records will not reduce the terrorists ability to strike without warning. If we wait for a magic bullet that will have 100% success in the war on terrorism, then we will lose many battles unnecessarily. Then is no magic bullet, instead we have to develop an arsenal of weapons to counter terrorism and apply them judiciously. Furthermore, since terrorists adapt and change in response to the evolving global situations and technological advances, we must strive to proactively, as well as reactively, defend ourselves against our enemies.

By applying privacy laws written with outdated communication technology in mind, we are reducing our ability to utilize and counter modern communcation methods. Our enemies are not hampered by such regulatory guidelines and thanks to the elite infrastructure funded through the largesse of OBL, Saddam, the government of Iran amoung others, unsophisicated operatives have the benefit of technological expertise.

Analysis of calling patterns, when combined with leads of potential terrorists agents and activities can provide a useful data base. If no data base is extant when other intelligence provides leads, there is a delay while this data is accumulated, a delay that could make the difference in whether we are able to respond in a timely and effective manner.

These communications records have been compiled for years, ever since comminication became digital. The same is true for records of electronic financial records. I submit that railing against the increasingly public nature of our lives is akin to bitching about CDs replacing vinyl records, or cordless phones replacing the more secure corded phones, or the issuance of social security numbers and the advent to the mark of the beast as prophosized by the Bible.

While many are comforted by the thought that the ills of the world are the result of an identifiable evil force with a plan, I think many unsettling societal changes are the inevitable effects of settling into the information age. Also, with the phone carriers denial of any release of information, I think that it is too early to ascertain what has actually happened.

Conspiracy theories enjoy popularity because they have the appearance of clarifying uncertain situarions, they provide a ready made enemy to focus upon, and the supporting evidence (such as it is) is generally circular and difficult to refute. However, anyone who has ever tried to motivate an infrastructure to achieve a complicated, multitask goal, competently and covertly, can attest to the fact that is easier said tnan done. Doing this with government workers would be a monumental task. Government service and underachievement go hand in hand. First, productivity is this group is miminal in most circumstances, and very little of consequence gets done after lunch on Friday or before lunch on Monday.

I am not saying that it is impossible for the government to operate a large scale conspiracy to violate or circumvent the law, but I feel certain that there is a chicken little niavite in the eager acceptance that Big Brother is a sinister puppet master laying traps.

I don’t think the analysis of records will produce anything of value. However, there is a downside. Assume a terrorist, using his own phone, dials a wrong number: yours. Guess who will be brought into the web of possible terrorists? You. People have pointed out a number of ways terrorists can exchange information without creating a trail or pattern.

By the way, I don’t lock the door to my car because I don’t keep anything of value in it. Also, I once called AAA when my keys were locked in my trunk. From the time the guy from AAA arrived, opened my car, filled out the report, a min. had passed. I don’t think it took him more than 3 sec. to break into my car without special tools.

One of the problems with amassing these phone records is that we simply do not know what they are really doing with them. There are no checks and balances if amassing them are outside of the law. Briefing members of congress who are gaged does not constitute a check. What can the gaged congressman do?

First, there is no doubt that the government has the ability to track communications through the phone system, web, and even drafts saved on encrypted servers. Whether they can accurately recognise, analyze and decode terrorist communications is questionable.

The Bushites stories keep changing on this subject. First they say that they are not spying on Americans without a warrant - a bald faced lie. Then they say; well OK, we are spying on a few Americans without a warrant - but only the ones that are talking to terrorists outside of the U.S. Then they say; well OK, we are spying on all Americans, but it is impersonal, and we are not data mining and getting any information. Then they say; well OK, we are data mining and getting all kinds of information, but it is for your own good… How are we supposed to trust these people? Why should we assume that with no congressional or judicial oversight, that the Bushites are not abusing this awesome illegal unbridled power? Why should we assume that no future government will abuse this awesome power? The power will be abused.

To date, I haven’t seen evidence of NSA misconduct except the FISA court avoidance. No one has suggested even that has actually been out of bounds espionage. Yet. There was supposed to be some testimony from a former NSA guy in the intelligence committee about a broader role than previously discussed. I haven’t heard anymore rhetoric about that. Is it a conspiracy? Maybe. But I’m given to believe more that there are plans to move this more within the confines of the FISA.

Is there a chill within congress? I doubt it. Is there chill effect on the press? That’s a little more worrisome to me. However, if Gonzales presses too hard on this it will likely blow up in his face. I don’t believe we’ve fallen into tyranny quite yet.
