Mueller - A Noble Public Servant or A Sleaze Job Report-Maker?

As legal experts like Andrew McCarthy at National Review and former law clerk and professor Margo Cleveland at The Federalist have pointed out over the last year or two, there is a special procedure with rules and regulations governing a special counsel like Mueller and key to those rules and regulations is this:

A criminal investigation is always predicated on the likelihood of a crime having been committed. A counter-intelligence investigation is a search for information on adversaries or rivals of one kind or another and is not bound by the same prosecutorial rules as a criminal investigation. If you conduct a criminal investigation where say, obstruction of justice and criminal conspiracy (collusion is a broadly defined term that is not usually considered criminal), then the end result of the enormous powers and resources you have as a prosecutor is to come to a yes or no decision on whether the crime that launched your investigation was committed. Or not.

It is a special counsel and any prosecutor's professional and therefore ethical responsibility to gather the evidence and come to a conclusion. Yes or no, based on the evidence.

Mueller apparently has done neither.

I haven't read all 400 plus pages of the report yet, I admit. But those who have or at least imply they have, are as divided as ever. This report likely changes nothing, unfortunately, as has been fairly clear for some time. What I have read so far is exactly what I've already read. It mirrors the mainstream media's official story on the probe. How it started, why it started, who it investigated and on and on.

And that's because it's all already been leaked by Mueller's team and by intel agencies that collaborated with, or were sources for, Mueller in putting together the report. So, people who want Trump impeached will find what they want because Mueller leaves all sorts of hints and suggestions without actually resolving them. You can practically hear him slapping the pigskin into Nadler's gut and saying: Go!!

Quin Hillyer, a GOP operative and failed candidate who clearly loathes Trump, has a jeering piece in the Washington Examiner that practically demands anyone skeptical of Mueller as well as his colleagues at that well-written and fairly conservative paper heap ashes on their heads and say: Not worthy! Not worthy! People like Byron York whose careful detailed following of the clues and evidence is what real journalists like York in fact did. While I find Hillyer's piece irritating in the extreme there will be plenty more like it both within GOP opponents and of course from the Democrats who are going through it carefully in order to launch impeachment proceedings. We'll hear from Nancy Pelosi and Chuck Schumer in a day or two surely.

It seems Mueller's report had that in mind. Margot Cleveland writes at The Federalist:

Notwithstanding Mueller's professed refusal to render judgment on whether to initiate or decline prosecution, Part 2 of the special counsel's report served solely to indict President Trump in the court of public opinion by providing detailed factual conclusions that seemingly support obstruction of justice charges--at least based on the special counsel's view of the law.

So this report is political and not prosecutorial. Does Mueller realize this? How can he not? Consider all his experience as a former FBI Director and his experience as:

• An Assistant US Attorney

• A US Attorney

• A D.C. Prosecutor, and

• A US Deputy AG (just like Rod Rosenstein)

There is nothing with regards to legal and political process in Washington D.C that this man has not dealt with or investigated. His approach to the report has apparently been to politicize the process and leave Congress in charge of the final act.

In other words, this has really been an impeachment process from the beginning. From when the FBI started their investigation a year before Mueller was appointed. It's there in his report, how an unnamed diplomat who is obviously Aussie ambassador Alexander Downer relayed his chat with Papadopoulos to the FBI after the Wikileaks dump and this was the reason the investigations began. No answers to the various questions that reporters like York and Cleveland have been asking for almost 2 years now about facts that suggest the investigations began much earlier. Just the same official story.

So, as far as public opinion and opinions in the beltway, this likely changes little aside from perhaps hardening attitudes. What it does do politically seems to be to give a boost to Democrat moves to try and impeach Trump. While claiming not to be doing precisely what it is in fact doing.

From the report:

An individual who believes he was wrongfully accused can use that process to seek to clear his name. In contrast, a prosecutor's judgment that crimes were committed, but that no charges will be brought, affords no such adversarial opportunity for public name-clearing before an impartial adjudicator. The concerns about the fairness of such a determination would be heightened in the case of a sitting President, where a federal prosecutor's accusations of a crime, even in an internal report, could carry consequence that extend beyond the realm of criminal justice.

No. Fricking. Kidding.

Margot Cleveland final thoughts in her piece:

But Trump has no process now to clear his name from the taint of obstruction of justice created by Mueller's report. So, after two years of battling unjust and untrue charges of collusion with Russia, Mueller has destined President Trump to spend the second half of his first term combating claims of obstruction of justice--claims which, even if they had a basis in fact, have no basis in law.

This is the last thing Democrats, Republicans, or America needs.

It is indeed remarkable that President Trump accomplished all that he has with so many people and institutions attempting to do him great political and personal harm.

His efforts to make America great again despite all the powerful forces aligned against him, have mostly succeeded.

President Trump, based upon his administration so far, will be remembered as one of triumph against the evil, greed and envy of small minds.

The nation has benefited greatly from the efforts of this president.

Say What? What are you trying to accomplish by pandering to the numpties? They aren’t even capable of understanding what you’ve written except that you’re on their side. What is it that you hope to accomplish by participating in the spreading of more zombie lies? It’s a dead website with fewer than 3 or 4 people participating on any given day. Do you think nonsense like this article is going to increase that, or are you only doing it to maintain those 3 or 4 people as “readers”? This website used to be dominated by the left. Any time there was a disagreement the person was banned or shunned. ohrealy enjoyed his participation in the choir. He misses being preached to. Now that facts are being presented that can’t be poo pooed away he wants the entire site shut down.

Most people with a credible point of view would present that point of view and accept the consequences. ohrealy hasn’t the guts to present a leftist point of view. He’s happy spending his time looking for obscure terms to fill his comments with.

ohrealy, ask the Democratics who left WatchBlog where they went so you can rejoin the choir, or do a little research that has some value and make a legitimate point you can defend for a change. Calling for violating the 1st amendment of others is unAmerican.

Independent (swing) voters usually decide elections, and it’s unlikely independent voters are going to choose socialism, higher taxes, more government-run healthcare, open-borders, more sanctuary cities, more than the current 1 Billion per year in net losses due to illegal immigration, more un-fair trade, more than the current 2,000 homicides per year by criminal non-citizens, more bureaucracy of nightmare proportions, the “New Green Deal”, etc., etc., etc.

Why isn’t anyone demanding Japan take more refugees? What about Russia and China? Why aren’t the Globalists complaining that these countries aren’t accepting enough of the world’s human refuse? Is it because they have respect for their nation?
