​Was McCabe Authorized to Leak? Comey Doesn't Know ...

It looks like James Comey may be called to testify against Andrew McCabe, his former deputy at the FBI. Here’s how an article by Tim Hains in Real Clear Politics sums up the situation:

In a book tour interview with CNN's Jake Tapper, fired FBI director James Comey comments on reports that the Justice Department inspector general recommends former deputy FBI director Andrew McCabe be criminally charged for lying to internal investigators about leaking.
Follow the bouncing verbs in the preceding paragraph as we work backwards through how the information flowed from one person to another:

There was a leak. When leaking you have 3 or more actions: Someone talks (face to face or by phone usually) to a journalist. That journalist writes a story. That story is read by the public. Or, the journalist's story becomes the basis of a newscast that is read by an anchor which is seen by the public. In McCabe's case, he apparently gave the go ahead to former FBI counsel Lisa Page (the texting lawyer who was Peter Strzok's lover) to talk to WSJ reporter Devlin Barret.
McCabe lied to DOJ investigators about leaking. That involves several actions: he talked to investigators or responded in writing to their questions and omitted or distorted what happened when he apparently and perhaps illegally authorized the leaks.
A lawyer for Andrew McCabe has confirmed to journalists that DOJ Inspector General Michael Horowitz has issued a criminal referral to the U.S. Attorney's office in D.C. over McCabe's lying about leaking to the media through former FBI counsel Lisa Page. Note that journalists like Katie Bo Williams, writing for The Hill, used the verb "confirmed." Does she mean that someone else perhaps close to Horowitz leaked the news that Michael Horowitz has recommended that Andrew McCabe be charged to her, and that McCabe's lawyers then confirmed it to her?
James Comey in an interview with Jake Tapper then comments on this news which Jake Tapper has relayed to him. And Comey's comments are viewed on CNN and form the basis of stories like the one in Real Clear politics that people like me then read.
So here we have a process with at least a dozen different people who were either involved in ways that are quasi-legal (DOJ investigators) or legal (D.C. Attorney's office) or involved the media (the journalists). All of this in a highly partisan and dangerously charged political atmosphere. And it revolves around whether McCabe had the authority to leak to the press, because it seems clear that he did indeed lie. In the MSNBC interview with Rachel Maddow, Comey said this in response to Maddow's question on whether it was wrong for McCabe to leak:

I don't know for sure, I know that he didn't tell me about it, didn't ask me about it before he did it. I think the inspector general's report is right in that respect. And I would have expected that. But I think he had the authority to do that and I think if he were here he would say I didn't need to talk to the boss because I had the authority to do that. And that's a hard one because given all that was going on at that point, I would have expected him to talk to me but as a matter of rule he had the authority.
So there you have it, a crystal clear answer from the former Director of the FBI: I don't know for sure. Can anyone know for sure when trying to disentangle the dense web of actors in the various probes and investigations? This is a case of administrative, quasi-legal process tunneling up it's own backside with nary a surfboard in sight. And lots of crap being thrown around by everybody.

We do know at least that McCabe lied. Will he now be charged the way Mike Flynn was? Whose omissions were probably accidental and not a deliberate attempt to mislead? Or do the FBI and the DOJ have a different standard for their own employees?

Michael Cohen will plead the 5th.

This administration has already set a record for most indictments in its first year.

Hillary Clinton has never been indicted, despite 8 investigations over 4 years with Benghazi. In the e-mail probe, she was exonerated not only by Comey, but by 12 analysts and prosecutors who weighed in. Obama ran one of the cleanest administrations in American history.

Neither Comey nor McCabe have been indicted, nor are they likely to be. For the record, both are Republicans.

Other records set by Trump:
Most vacation.
Most games of golf.
Most lies- over 3,000 documented.
Most resignations/firings.

As for Michael Cohen, I don’t think taking the 5th will save him.

I don’t trust either one of them. They are all protecting the FBI, and so is Mueller. Mueller may actually be functionally running the FBI. Wray is only the director because he was previously defending money launderers. Mueller may be using him as a source for indictments.

My wife just finished the Comey book. Don’t think I will read it. Basically, I don’t care about Comey or McCabe. They made a terrible judgment call going after HRC before the election, and that is putting it charitably. Their only interest to me at this point is as credible witnesses for Obstruction charges against Trump. As is typical in that field, both made copious contemporaneous notes and documented conversations, so they have almost certainly covered themselves.

So Cohen has officially notified the court he will plead the 5th. Yet another record for the Trump administration- the president’s personal lawyer pleading the 5th. Of course, that is his constitutional right. What does Trump have to say about pleading the 5th?

“The mob takes the Fifth. If you’re innocent, why are you taking the Fifth Amendment?”


Ah, Felix Sater, another Trump Tower crook. Need a roster to keep track of all the crooks and traitors! Sater pleaded guilty to a Russian stock fraud scheme for $40 million, and then acted as an informant for the FBI.

“In late January 2017, Sater met with Ukrainian politician Andrey Artemenko and Donald Trump’s personal lawyer, Michael D. Cohen, at the Loews Regency in Manhattan to discuss a plan to lift sanctions against Russia… Sater gave Cohen a written proposal in a sealed envelope that was delivered to then-National Security Advisor Michael T. Tomorrow Pruitt from the EPA will be testifying. He is very corrupt, but I try not to let Trump administration corruption distract me. From ‘Day One’ I figured this would be the most corrupt administration in American history, and sure enough, the firings and resignations just keep coming.

In addition, VA nominee Jackson might give up tomorrow. It is a matter of time. Again, I try not to let the sheer ineptitude and incompetence of the Trump team distract me. Typical. They don’t vet, they don’t interview, they place people in positions for which they have no qualifying experience. Jackson has no significant managerial experience, and he is going to run something as huge as the VA? Really? But there’s a long list of those types in place already- Carson, DeVos, etc. A knucklehead Climate Change Denier from Oklahoma will be in charge of NASA. Apparently the plan is ‘no more earth science!’ And he’s not even the worst of the bunch.

Maybe he can come up with a way to launch coal-powered rockets.

But as bad as the corruption and incompetence may be, we can survive that. The Russian probe needs to be the focus. That is the existential threat to democracy and free elections.

2 things to consider for if the Mueller investigation reveals no evidence of Trump/Russia collusion:

1 - Having been intentionally and dishonestly worked into a frenzy, just like they were over the Hillary loss, leftists will start their destruction, riots and violence back up.
It will be worse than before and Americans will start confronting the leftists.

2 - The leftists that now run the Democratic Party have now set a precedent for unstatesmanlike behavior and have put it on the floors of our government. They have replaced simple disagreement over policy, with personal hatred for those who disagree.
Those on the right will return in kind.

Hope you guys are happy with what you have created.

Most likely that is NOT how it will go down. There will certainly be huge protests if Trump fires Mueller or Rosenstein. I can tell you that for a fact.

More likely, the Mueller investigation will issue a report to Congress on Obstruction of Justice by Trump. That part of the investigation is relatively straightforward compared to the other two major areas of investigation, money laundering and ‘collusion’ (conspiracy to violate campaign finance laws).

Several others face legal jeopardy: Trump Jr., Kushner, Manafort, Gates, Flynn, Roger Stone, Michael Cohen, and others. Those people could be pardoned by Trump. Gates and Flynn have already pleaded guilty and made plea bargains. Manafort’s lawyers recently confirmed he will face charges of ‘collusion.’ Trump Jr. has NOT been interviewed by Mueller, which means he is a target for both Obstruction and ‘collusion.’ Sam Nungate publicly said he believed Stone had perjured himself. Kushner faces a whole raft of potential charges, including ones stemming from collusion charges due to that Trump Tower meeting with Manafort, Trump Jr., and the Russians.

The great unknown is whether Mueller will make the report on Obstruction by Trump first, and wait to see if Congress removes Trump from office. That would solve the issue Trump pardoning the other crooks and traitors. I think issuing a report on Trump first is unlikely, not because Trump is innocent, but because the GOP will not go through with impeachment, no matter how bad the report looks.

The other option is to charge everyone at once with everything at hand. The problem is obvious: Trump will simply pardon everyone, and once again, hope Republicans will not remove him.

The situation with the Stormy Daniels case also threatens Trump with Conspiracy to violate campaign election laws. Today Trump very unwisely announced he was involved, AND that Cohen did very little legal work for him.

I imagine there are a lot of VERY unhappy lawyers on Cohen’s legal team this morning.

Sorry to burst your bubble, but that FBI IG report came out on 4/13.

The Obstruction charge against Trump will most likely address two specific instances: 1) Firing Comey, and 2) creating a false account for the meeting in Trump Tower on June 9th, 2016.

Trump’s efforts to stop the investigation and attack & discredit the investigators- Mueller, Comey, McCabe, the FBI, and the DOJ- form part of the larger context.

Initially, Trump denied his campaign had no contact with the Russians. We now know there were over 30 contacts. Trump denied there were any meetings with the Russians. In fact, there were several.

At every step of the way Trump has lied, denied, deflected, and thrown out distractions. It is not a crime to do any of those things. But as GOP Congressman Trey Gowdy said, if Trump is innocent, he should act like it. Once again, this provides the larger context for an Obstruction charge.

And just to repeat, Obstruction for Trump will probably take the form of a report from Mueller to Congress. It will be up to Congress to do anything about it.

Here is part of the e-mail between Trump Jr. and the cutout, Rob Goldstone, prior to the meeting on June 9th, 2016.

“The Crown prosecutor of Russia met with his father Aras [a Moscow-based developer who tried to partner with Trump in a hotel project] this morning and in their meeting offered to provide the Trump campaign with some official documents and information that would incriminate Hillary [Clinton] and her dealings with Russia and would be very useful to your father.

This is obviously very high level and sensitive information but is part of Russia and its government’s support for Mr Trump – helped along by Aras and Emin.”

On the same day Trump Jr. replied:

“… if it’s what you say I love it especially later in the summer.”


On June 7th Trump announced:

“I am going to give a major speech on probably Monday of next week and we’re going to be discussing all of the things that have taken place with the Clintons. I think you’re going to find it very informative and very, very interesting.”

Steve Bannon later called the meeting “treasonous” and said: “The chance that Don Jr. did not walk these jumos up to his father’s office on the twenty-sixth floor is zero.”

Was Bannon correct? That is all we know at this point from his point of view, and remember, Bannon lies a lot.

Taking the meeting was illegal. It would be considered a conspiracy to violate campaign finance law because the Trump campaign expected to receive something of value, regardless of whether they actually did receive anything. So what, if anything, did they receive? That we do not know.

Hope Hicks stated to Mark Corallo “the e-mails will never get out.” That shows consciousness of wrongdoing, and at the time Corallo thought it was obstruction of justice. He resigned shortly thereafter.

When news of the meeting & e-mails came out, Trump Jr. and Trump showed consciousness of guilt by lying about it. Trump attempted to create a false narrative on Air Force One, that the meeting was not about Dirt on Hillary, as per the e-mail subject line that we have all seen, but adoptions.

That is incorrect. Rosenstein said Trump is not a target. However, Trump is a subject of investigation, and a subject can become target at any time.

If Rosenstein believes a sitting president can not be indicted, then a president can never be a target of investigation. The DOJ can only issue a report. It would be up to Congress to decide what, if anything, to do about it.

I’m not sure what you or anyone else expected re Comey. The memos and the book match written contemporaneous accounts by Comey and by his peers, such as Dana Boente. They documented everything.

‘Collusion’ is not a legal term. There is no such thing as collusion in the world of law. The legal term is ‘conspiracy’- in this case, to violate campaign finance laws.

Trump has repeatedly declared Comey has “committed many crimes” and is “guilty of crimes.” However, whatever people may think of his judgment, Comey has been consistent, told the truth, documented it in writing, and others also documented it at the time.

The basic idea here is to attack Comey, McCabe, the FBI, Rosenstein, Mueller, and the DOJ to discredit them in the Russia probe.

Trump, meanwhile, has lied a lot. It is a matter of record. He has no credibility. None.

Despite all the wishes for HRC & Obama & Comey and so on to be charged with something, it has never happened.

On the other hand, Trump settled a fraud case for $25 million, refuses to release his taxes, and his administration also has set the record for most indictments for his first year in office. And the year is young!

I recommend Russian Roulette by Corn and Isikoff. I’m up to the part with all of Sater’s crooked deals. One good reason to read it is they do a good job of explaining the hacking for someone who found Nance’s book too technical. Sater is probably bipolar. Isikoff and Corn do a pretty good summary of details from a variety of sources, including some that most people have probably missed. Glenn Simpson was reporting on Deriapaska when he was at the WSJ. I’m reading about Manafort now. He goes all the way back to GHWB41 before he became toxic.

The North Korean underground testing facility reportedly collapsed last year. It seems strange no one reported on it. Supposedly the first cave-in killed 100, and during the rescue effort another 100 were killed in a subsequent cave-in. One can only hope their researchers were caught in the collapse. NK may not have the $ to build a new underground facility, so giving up testing in exchange for whatever they can get makes a virtue out of necessity. That’s fine. They know it, and we know it, and they know we know it. Until their society opens up, I would not trust anything the North Koreans do or say, but I see no harm in negotiating, other than enhancing the status of Kim Jong Un, and demonstrating to the world that developing nukes is a great way for third world countries to get what they want.
