Who's The Cracker?

President Bush just nominated John Roberts Jr., a virtual unknown, to fill Sandra Day O’Connor’s place on the Supreme Court. This is really an excellent, calculated, political move.

President Bush and his political operatives can privately assure "the base" that Roberts is against Roe v. Wade, affirmative action, organized labor, separation of church and state, and whatever else they might want to hear, but nobody really knows if he is or he isn't. The Christian block can nudge-nudge, wink-wink at each other all day long, but they really have no idea what Roberts will do.

On the other side, there's nothing substantial in Roberts' career on which Democrats can hang a filibuster. There just isn't enough public information to know for sure how much legislating from the bench Roberts will do once he's confirmed - and, unless he refuses to answer questions or says something really stupid, he will be confirmed.

The press would dearly love to see a dramatic response by Democrats, but there's nothing yet. Bush's announcement was met with a wait and see attitude by Democratic leaders. Sure, the guy's a GOP political shill as well as a conservative, but nobody expected anything less from a Bush nomination. From that standpoint, I think Democrats and "North-Eastern Republicans" like Sen. Specter can chalk this one up as a win - Roberts is certainly no Roy Moore.

My prediction: All the drama will be generated by the professional advocacy industry on both sides (it's what they're paid to do, right?). We'll get some rhetoric and really pointed questions from Democrats in Congress (their constituency expects it), and the hearings will be followed by a successful confirmation vote.

Unless Roberts really screws up, the only uncertainty is how many Democrats will cast an "up" vote - not that it matters, Republicans control enough votes to confirm him, anyhow.

BTW, one interesting, tangible thing about Roberts is that he's a middle-aged, white male. After all the speculation over a possible Hispanic or female nominee, it's a little surprising that President Bush chose a cracker.
